Patent Agent Exam Training - Patent Act and Rules - Module 1

In order to qualify the Indian Patent Agent Examination, a candidate shall be required to secure:

Paper I: Patent Act and Rules, 2 hours

• Qualifying marks: 100

• Objective Type - 40marks

• Descriptive Type - 60 Marks

Paper II: Drafting & interpretation of patent specifications and other documents, 3 hours

• Qualifying marks: 100

• Drafting Patent Specification - 60 Marks

• Descriptive Type - 40 marks

Viva Voce, 50 Marks

To qualify for the exam, a aggregate of 60% of all the papers  and minimun 50% in each paper is must.

This updated module contains detailed interpretation of each and every section of Indian Patents Act 1970, along with case studies and illustrations.

Preparation for patent agent examination needs thorough understanding of the subject. The students are required to go through each and every section as well as rules, remember all important sections, forms and applicable fee. Important questions have been given at the end of each Chapter in Module I and Module II, which shall be solved by every student and shall be sent back to Origiin IP Academy for verification, either in the form of soft files or hand written answer sheets. Additional assignments and model question papers are also provided to assist student prepare and practice for the examination

The study material has been prepared purely from the examination point of view. The Sections in the Act have been taken as a base and corresponding Rules have been mentioned at the required places. The format and sequence of the Chapters and Sections have been maintained so that it is easier for the students to remember the sequence of Sections which is very important for the examination. The Sections and Rules important for the examination have been labeled so that students can give emphasis to important questions while reading.

The Act has been interpreted to easy language for understanding of the concept. We have tried our best to maintain the original flavor of the actual statue, however, our interpretation may divert from the interpretation done by another person.

Some of the examples and case-studies in the study material have been taken from “Manual of Patent Practice & Procedures, 2008”, published by Indian Patent Office to give insight into real cases related to assessment of various aspects of patent law by Indian Patent office.
