Fundamentals of Contract Management

This course aims to provide and/or enhance learner’s skills and knowledge regarding Foundational Elements, Core Concepts, Governing Laws and Principles about Contracts This understanding is prerequisite to begin, sustain or advance a career in this profession. After completing this course, participants will be able to use the learnings while drafting, negotiating, interpreting or administering their business contracts and commercial agreements. 

The course has been structured into six topics as mentioned below

1. Key Foundational Concept about a Contract

2. Contract Laws and Principles

3. Essential Elements of a Valid Contract

4. Consequences of Breach of Contract

5. Difference b/w Terms, Conditions & Warranties

6. Contract Life Cycle & Various Stages

Each topics is further divided into 3-4 lectures. Lecture Contents have been explained through practical examples, real life scenarios from the industry and knowledge check exercises. Appropriate and relevant quiz/MCQ have been added in each topic and detailed explanation provided for the right answer so that learners could check their understanding.

Topic 1 covers the meaning and legal definitions of key terms such as Contract, Agreement & Consideration and explains how an MOU is different from a Contract. Topic 2 provide key information about governing laws in relation to contracts and sale of good transactions in India, USA, UK and Qatar. This topic also covers various contract types as defined under contracting laws (e.g. Valid v/s Void Contract, Express v/s Implied Contract, Quasi and Contingent Contracts and Contract of Indemnity. Topic 3 explains all such essential elements which must exists in a contract for the contract to remain valid and legally enforceable. Such elements have been explained with practical and real-world examples from the industry and learners will apply this learning to see that their business contracts contains all such elements.

Topic 4 is very interesting topic and after going through the same, learners will come to know their contractual rights & obligations along with various remedies available to them, under Contracting Laws, when there is a breach of contract by other party. After going through Topic 5, learners will get the true meaning of key legal words such as Terms, Conditions, Warranties, Essence of the Contract and they will be able to distinguish conditions from warranties. Topic 6 explains Contract Life Cycle in good detail and its various stages
