As you know, purpose of a patent search is to identify relevant patent documents. The term patent document includes both patent applications and granted patents. It is interesting to note that the results of patent search may be used in multiple manners based on the kind of patent search one is going to perform. In all kinds of patent searches, the most critical part is to obtain the most relevant patent documents.
Accuracy of patent search result depends upon the search techniques used and the strategy employed to perform search.
In this module we will learn various techniques that are commonly used to perform a patent search.
Now we will learn further steps of patent search, that is adoption of various search techniques in patent and non-patent databases
Explore pattern search techniques, including keyword search, classification codes, Ehsani and inventor searches, and citation analysis, to identify relevant patent and non patent literature in patentability assessments.
In this Module, we will take up a few examples to demonstrate the process of patent search.
After going through the examples, you are requested to repeat the process of patent search independently and check if you are able to get relevant hits.
In Module 5, we will learn about the steps for writing a patent search report based on the results obtained using various patent search databases.
Patentability search is performed to ensure patentability of invention on the scale of novelty, non-obviousness and industrial utility. However, identification of correct key words, formulation of appropriate search strategies, assessment of identified prior art, evaluation of invention against statutory requirements is extremely critical for performing patentability search. The search requires deep understanding of the concept underlying the invention and requires a comparative analysis between the invention and the prior art. Once search is performed, a report or opinion is prepared, based on which the inventor can decide whether to file for a patent or work further on the invention based on the identified prior arts.
